1. Acceptance of Terms

By downloading, installing, or using the NY EMS Protocols application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

NY EMS Protocols is a mobile application designed to provide quick reference access to New York State Emergency Medical Services protocols, procedures, and related educational materials for EMTs, EMT-CCs, and Paramedics serving NYS, NYC, Nassau, and Suffolk Counties.

4. Medical Disclaimer

IMPORTANT:

This App is intended for use as a reference tool only and is not a substitute for professional medical judgment, training, or direct patient care protocols established by your medical director or agency.

• The information provided in this App is for educational and reference purposes only
• Always follow your local medical direction and agency protocols
• In case of any discrepancy, defer to your medical director's guidance and official protocol documents
• The App developers are not responsible for clinical decisions made using this App
• Protocol information may change; users are responsible for verifying current guidelines with official sources

5. Subscriptions

5.1 Subscription Services

Certain features of the App require a paid subscription to NY EMS Protocols Pro.

• Subscription fees are billed through the Apple App Store
• Monthly and yearly subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Payment will be charged to your App Store account at confirmation of purchase
• Your account will be charged for renewal within 24 hours prior to the end of the current period

5.2 Cancellation

• You may cancel your subscription at any time through your device's App Store settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• To cancel, go to Settings > [Your Name] > Subscriptions on your iOS device

5.3 Free Trial

If a free trial is offered, it will automatically convert to a paid subscription unless cancelled before the trial ends. You can cancel at any time during the trial period without being charged.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Share, distribute, or reproduce App content without authorization
• Use the App in any way that could damage or impair the service
• Share your subscription or account access with others

7. Intellectual Property

• All content, features, and functionality of the App are owned by the App developers
• Protocol content is based on publicly available New York State EMS guidelines
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes

8. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES OR REPRESENTATIONS REGARDING:

• The accuracy, completeness, or timeliness of the protocol information
• The availability or uninterrupted access to the App
• The suitability of the information for any particular clinical situation
• That the App will meet your specific requirements or expectations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or data
• Personal injury or property damage
• Any damages arising from your use or inability to use the App
• Any clinical decisions made based on information in the App

11. Indemnification

You agree to indemnify and hold harmless the App developers from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
